Bangkok Administrative Court Decision:

On December 18 at 10:00 the Bangkok Administrative Court will give their decision. This decision will rule on the 200-meter measurement. Which is going to determine if Pattaya City Hall gave a legal building permit for the construction of View Talay 5, 6 and 7.

Big Dissapointment!

Business as usual in the thai courts,

Bangkok Administrative Court decision was the same as the Rayong Administrative Court. The Rayong court decided that you measure 100 meters into the sea before you measure100 meters onto the land. And this method extended the area which was protected as Issue 9 required. Bangkok Administrative Court agrees with the Rayong court and refused to revise the decision. Actually the Rayong court decreased the protect area on the land. The new Issue 9 regulation required the area to be extended or increased. The sea doesn’t need to be protected from buildings and the Building Construction Act doesn’t have authority in the sea. So mush for the small details!
Only the Thailand Supreme Administrative Court can change the Pattaya City Hall method of measuring. Rayong Administrative Court decision was appealed to the Supreme Administrative Court and there were healing healed in 2013. We wait for their decision.
