          Embattled sea gypsies demand rights over their home

          The embattled sea gypsies facing eviction from southern Thailand submitted a petition to the Ministry of Justice in order to call for rights over their home.

          Members of the sea gypsies community from Muang District of the southern province of Phuket on Thursday, 11 February 2016, met with Tawatchai Thaikeaw, deputy permanent secretary of the Justice Ministry.

          The group travelled to the ministry to submit the petition to Gen Paiboon Koomchaya, Justice Minister, to urge the authorities to investigate into the land dispute between their community and Baron World Trade Co, an estate development company, who claims ownership over a disputed 33 rai on Rawai Beach in Phuket, where about 2,000 sea gypsies form three tribes, Morgan, Morglen, and Orang Laut, have settled.

          The sea gypsies claimed that their ancestors settled in the disputed area for over 300 years.

          In the petition, the group demands the Justice Ministry to order the Department of Special Investigation (DSI) to investigate the land dispute and protect them from at least 100 men, who allegedly used violence against them and destroy their properties in order to evict their community.

          They also called for compensation for 34 sea gypsies who were injured from the recent violent skirmishes which broke out on 27 January between them and a group of unidentified men who were alleged hired by Baron World Trade Co to guard the company construction site adjacent to the sea gypsy community.

          According to a leaked document circulated on social media, before the violence skirmishes broke out last month the company contacted the Royal Thai Army to deploy military personnel to guard company workers as they started to construct villas on the disputed land plot.

          The group said that they will also travel to the Department of Lands to urge the department to revoke the land title that was issued to the company, saying that it was issued by illegitimate means.

            Halt Forced Eviction, Assess Claims to Chao Lay Ancestral Land

            More than 30 indigenous Chao Lay were injured in the violent attack and forced eviction of their community in Thailand's Phuket province on January 27, 2016.
            footageBrad Adams,letter dated December 30, 2015, Chatri Madsatun, a representative of Baron World Trade Ltd., reported to military and civilian authorities that the company has legally obtained title to the land to develop a luxury villa project on Rawai Beach but construction work has been obstructed by Chao Lay who refused to leave the disputed land.

            Under international standards, notably the United Nations Guiding Principles on Business and Human Rights, companies have a responsibility to ensure that their operations do not contribute to human rights abuses and to remedy harms that may have occurred. Representatives of Baron World Trade Ltd. in Phuket province did not respond to multiple telephone inquiries by Human Rights Watch for their comments on the incident and to describe what steps they may have taken to prevent or address the violence.

            According to media reportsordered Baron World Trade Ltd. to halt its construction project and remove the rocks blocking the passage in and out of the Chao Lay community. But to date, the local police have made no apparent progress in their investigation of the violence. The Chao Lay filed a complaint with the Justice Ministry on February 11 asking their cases to be handed over to the Department of Special Investigation to ensure impartiality and efficiency.

                      Thai Public Broadcasting Service (Thai PBS) reportedManager Online, Ngum in 2014 participated in an event where the Department of Special Investigation (DSI) returned the bones of sea nomad ancestors buried on Rawai Beach to the community after the bones were taken for forensic examination in order to prove that the sea nomad community has been living in the disputed land plot for many generations. The Manager Online reported that Ngum is the leader of the community.

                      The indigenous seafarer community on Rawai Beach where about 2,000 people from three sea nomad groups, the Moken, Moklen and Orang Laut live continue to face uncertainty in a standoff with Baron World Trade Co, an estate development company, who claims ownership over the plot.

                      The battle between the community and Baron over the plot of land on Rawai Beach made headlines on 27 January after a violent confrontation broke out between a group of 70 seafarers and a group of men reportedly hired by the company.

                      The skirmishes began as the Rawai Beach seafarer community representatives were on their way to Phuket Provincial Hall to submit a petition to the Damrongtham Centre, one of the centres established to accept public complaints, to urge the authorities to protect their community and livelihood. The men allegedly working for the investors used an excavator to lift big rocks to seal off the entrance to the community while the military and police officers reportedly just looked on.
