      Assets worth Bt7 billion seized in rice deal case

      The Anti-Money Laundering Organisation (AMLO) has seized multiple bank accounts and land plots worth nearly Bt7 billion in connection with the fake government-to-government (GtoG) rice deals signed by former commerce minister Boonsong Teriyapirom.

      The multi-billion-baht assets belong to Siam Indiga Co, Siralai Co and persons related to Apichart Chansakulporn, better known as Sia Pieng, according to Pol Gen Chaiya Siriamphunkul, secretary-general of AMLO.

      He said the National Anti-Corruption Commission had ruled that Boonsong and 21 others were guilty of helping the private firms to buy rice from the government's pledging scheme at a price lower than the domestic price without a competitive bidding process.

      Then, these domestic rice transactions were used as bogus GtoG rice deals between Thailand and China. The wrongdoing led to financial damage in excess of Bt20 billion for the Department of Foreign Trade.

      According to AMLO, the assets seized by the agency include 51 bank accounts worth a combined Bt921 million and 611 land plots in Bangkok, Lampoon, Phuket, Phang Nga, Ayuthaya and Angthong, worth a combined Bt5.97 billion.

      The fake GtoG rice deals were signed during the tenure of Yingluck Shinwatra government which implemented a massive rice-pledging scheme to buy an unlimited quantity of rice from farmers for Bt15,000 per tonne compared to the then-prevailing market price of Bt7,000 to 8,000 per tonne.

      Bogus GtoG rice deals were then used to show that the government was able to export a significant amount of rice to reduce its financial burden. It was later found, however, that the deals were in fact domestic rice transactions carried out by Siam Indiga and other private firms.

        B7bn in assets to be seized from suspect rice traders

        The Anti-Money Laundering Office (Amlo) is preparing to seize assets from two companies including Siam Indica in relation to allegedly fake government-to-government rice deals.

        The asset seizure approved by an Amlo committee on Friday will involve 7 billion baht including money in 51 bank accounts, and land plots in Bangkok, Lamphun, Phuket, Phangnga, Ayutthaya and Ang Thong provinces.

        It involves Siam Indica and Saralai and people linked to Apichart "Sia Piang" Chansakulporn. Siralai has changed its name to Kitha Properties Co.

        Siam Indica has been the target of questions dating back to 2004 when the Thaksin Shinawatra government was in power. An affiliate of now-bankrupt President Agri, which was controlled by Apichart, Siam Indica in the past won auctions that rival rice exporters claimed were not transparent.

        Apichart was sentenced in 2014 to three years in jail after being found guilty of embezzling 20,000 tonnes of rice worth 200 million baht that was to have been delivered to Iran.

        Amlo secretary-general Chaiya Siri-amphankul said on Friday that the asset seizure decision was linked to corruption charges by the National Anti-Corruption Commission against former commerce minister Boonsong Teriyapirom and 20 others.

        They were accused of faking a government-to-government rice deal and reselling state-owned grain to domestic firms with close ties to the Yingluck Shinawatra administration.

        "The evidence and traces of the money transactions found that the firms and persons were corrupt by producing fake government-to-government rice contracts," Pol Gen Chiya said.

        "The investigation contains grounds that their assets were acquired in violation of money laundering laws and thus they must be seized."

              Commerce minister signs administrative order to recoup G-to-G rice deal loss


              Commerce Minister Apiradee Tantraporn on Monday signed an administrative order to demand compensation for the loss incurred from the fake government-to-government rice deals from former commerce minister Boonsong Teriyaphirom, his deputy Poom Saraphol and four other senior commerce officials.

              She explained that the order had to be signed by two persons in order to become effective, saying she signed on behalf of Prime Minister Prayut Chan-ocha and assigned commerce permanent secretary Ms Chutima Bunyaprapat to sign on her behalf.

              It was reported that Ms Chutima signed the order last week.

              After this, Minister Apiradee said former commerce minister Boonsong and his five associates implicated in the fake rice deals would be notified of the order so that they could respond in 30 days.

              And if there is no response from any of them within the 30-day period, another notification will be served so they can respond in 15 days after which the Legal Execution Department will begin the process of seizure of their assets to repay the loss from the fake deals estimated at about 20 billion baht.

              She admitted that she was worried with the signing of this administrative order which, she insisted, was done properly in accordance with legal procedure.

              The compensation to be paid by the six individuals is as follows: 1,770 million baht for Mr Boonsong; 2,300 million baht for Mr Poom; 4,000 million baht each from Maj Veeravuth Watjanapukka, former secretary of Boonsong; former Foreign Trade Department chief Manas Soithong, former Foreign Trade Department deputy director-general Thikumporn Nartworatat and Mr Akarapong Teepwatchara, former director of Foreign Rice Trade Office.

                B20bn rice compensation order finally signed


                After much-publicised reluctance, Commerce Minister Apiradi Tantraporn on Monday signed an order demanding 20 billion baht in compensation from former commerce minister Boonsong Teriyapirom and five ex-ministerial officials for false government-to-government (G2G) rice deals.

                Two people signed the order but neither of them did it in their capacities. Mrs Apiradi signed it on behalf of Prime Minister Prayut Chan-o-cha while commerce permanent secretary Chutima Bunyapraphasara signed it on Mrs Apiradi's behalf.

                In April, Gen Prayut ordered the commerce minister to sign the order seeking civil liability from the six defendants. Mrs Apiradi was apparently reluctant to sign the order, saying she was not a politician, even though Gen Prayut, as the junta's chief, had earlier invoked Section 44 of the interim charter to grant immunity from future lawsuits to all officials handling the rice-pledging cases.

                Ms Chutima, who will retire at the end of this month, said she would not sign it unless the minister authorised her to do so and her successor, Wiboonlasana Ruamraksa, was equally reluctant to take the move.

                Once inked, the order would then be sent to Mr Boonsong, former deputy commerce minister Poom Sarapol; former secretary to the commerce minister Weerawut Wajanaphukka, former director-general of the Department of Foreign Trade (DFT) Manas Soiploy, his then-deputy Tikhumporn Natvaratat and the DFT's former director of foreign rice trade Akharapong Dipavajra.

                The six must reply in 30 days. Failing that, they will be given a warning and another 15 days. Afterwards, the Legal Execution Department would begin seizing their assets, Mrs Apiradi said.

                She said she had studied legal aspects of the case well before the signing on Monday.

                Mr Boonsong was ordered to pay 1.77 billion baht in compensation, Mr Poom 2.3 billion baht, and the other four 4 billion baht each.

                Mr Boonsong, the commerce minister in the Yingluck Shinawatra government, along with 20 other individuals and companies already are being tried in the Supreme Court over the G2G rice deals with two Chinese trading companies: Guangdong Stationery and Sporting Goods Import and Export, and Hainan Grain and Oil Industrial Trading Co.

                The suit was filed after the National Anti-Corruption Commission found the foreign companies were not authorised by Beijing to make the deals.

                It was reported that instead some local traders bought farmer-pledged rice from the government at cheap prices and made profits by reselling it at market prices.

                Boonsong aims to block asset seizure

                To seek court injunction and file suits against officials over order linked to fake rice deals

                FORMER commerce minister Boonsong Teriyapirom will seek an Administrative Court injunction to block a government move to seize his assets in connection with fake government-to-government rice deals. He is also preparing to file counter-lawsuits alleging that top officials avoided due process of law.

                Justice Minister General Paiboon Koomchaya said the Department of Legal Execution would have to wait for the court's decision on this before it can proceed to seize the assets of ex-politicians and former officials at the Commerce Ministry involved in the case.

                Should the court grant Boonsong temporary protection, asset seizure would be suspended until there is a final ruling on this case.

                Boonsong and five others face a civil liability lawsuit filed by the Commerce Ministry for their role in signing bogus contracts "with China" to sell 6.2 million tonnes of rice as part of the previous government's rice-pledging scheme. A criminal case against Boonsong and others is still pending in the Supreme Court, but the Commerce Ministry has gone ahead with issuing an executive order to seize the assets of Boonsong and others.

                Deputy PM Wissanu Krea-ngam said if Boonsong and other former officials did not petition the court within 45 days, the Department of Legal Execution would proceed to seize the defendants' assets, as the government has claimed Bt20 billion in damages in connection to the fake rice deals. The department was authorised by a special order issued by Prime Minister Prayut Chan-o-cha under Article 44 of the interim charter.

                Paiboon said: "This case will not be in the hands of the Justice Ministry's Department of Legal Execution any time soon as it has to go through the Administrative Court's process first. There have been many cases involving bureaucrats' civil liability for causing damages to the state. After the court decides, we will step in to perform our duty accordingly."

                However, Boonsong, who is also a member of Pheu Thai Party, said the government had avoided due process by issuing an order under absolute power granted under Article 44, which was unfair. He said he would call on the court to suspend the asset seizure to prove the order was unlawful.

                The ex-minister also plans to file both civil and criminal lawsuits against those who exercise authority under Article 44 in this case, because, he said, they should rely instead on the rule of regular law.

                As for the rice deals, Boonsong insisted that no financial damage had resulted from the deals implemented by the Department of Foreign Trade under his supervision.

                Besides Boonsong, former deputy commerce minister Poom Sarapol and four other senior commerce officials are facing civil liability lawsuits in which the government is seeking a combined compensation of Bt20 billion.

                Distat Hotrakitya, secretary-general of the Council of State, said the case against Boonsong and others was based on the state officials' civil liability law, which empowers the government to seek compensation from those who commit wrongdoings and cause financial damage to the state.

                  Commerce Minister Apiradee Tantraporn said Wednesday that she was not worried with threat made by her predecessor, Mr Boonsong Teriyaphirom, to take her and the others involved in the issuance of an administrative order to seize his assets.

                  In his Facebook post, Mr Boonsong threatened to file criminal and civil lawsuits against all those responsible for ordering the seizure of his assets through the issuance of the administrative order.


                  The minister said that she was confident that all the legal proceedings concerning the fake G-to-G rice deals and the administrative order were above board. So if Mr Boonsong would like to take the case to the court, he could do so, she added.

                  The Commerce Ministry is now in the process of notifying Mr Boonsong and five other individuals involved in the fake rice deals of the administrative order and to respond within 30 days. And if there is no response within the 30-day period, the ministry will send another notification which must be responded within 15 days, failing that the Legal Execution Department will proceed with seizing their assets to compensate for the 20 billion baht in loss from the fake rice deals.

                  Mrs Apiradee said she would not answer any questions regarding this issue from the media.

                    The Foreign Trade Department has sent an administrative notice to the Legal Execution Department to demand about 20 billion baht in compensation for the loss from 6 million tonnes of G-to-G rice deals from six individuals, including former commerce minister Boonsong Teripaphirom and his deputy, Poom Sarasin.

                    FTD director-general Mrs Duangporn Rodpayat said Monday that two similar notices were served on the six individuals through the Legal Execution Department to pay the compensation and the deadlines had expired.

                    The other four individuals are Pol Lt-Col Veeravuth Watjanapukka, former secretary of Mr Boonsong, former FTD director-general Manas Soithong and former FTD deputy director-general Tikumporn Nartworathat.

                    The six men had lodged a petition with the Administrative Court demanding that the administrative notices be revoked and that the demand for compensation should be put on hold pending a ruling from the court regarding their petition.

                    Mrs Duangporn explained that if the court rules in favour of the six men, the legal proceedings to demand compensation from the six men will have to be suspended.

                    The amounts of compensation to be demanded from the six are as follows: Boonsong, 1,770 million baht: Poom, 2,300 million baht; Veeravuth, Manas and Tikumporn, 4,000 million baht each.

                      The Commerce Ministry has asked the Legal Execution Department to collect 20 billion baht from a former commerce minister, his deputy and four top commerce officials involved in allegedly bogus government-to-government rice deals.

                      Duangporn Rodphaya, director-general of the ministry's Foreign Trade Department, said on Monday that her department had sent the letter to the Legal Execution Department to demand the compensation for losses resulting from four G2G rice sale contracts covering 6.2 million tonnes of rice.

                      The letter seeking the execution followed a second letter earlier sent to the six people, demanding the compensation from them, she said.

                      The ministry has followed the steps required for the action to reclaim the losses through the administrative action. After the first administrative order, authorities waited 30 days for their payments. Since no payments were made, the second letter was sent to them and the authorities waited another 15 days for them to act. Now the case has reached the Legal Execution Department to enforce the payments.

                      At this stage, the accused may seek the Administrative Court's injunction to stop the process and prevent their assets from being seized but to date none of them has done so.

                      "The matter takes times, but the Commerce Ministry has done what's required.

                      "The Legal Execution Department will now look for their assets, which will also take time. If the court grants them an injunction, the procedures will be suspended and the court will take over the issue," Mrs Duangporn said.

                      The six are former commerce minister Boonsong Teriyapirom, his former deputy Poom Sarapol, ex-secretary to the former commerce minister Weerawut Wajanaphukka, former Department of Foreign Trade (DFT) director-general Manas Soiploy, former deputy DFT chief Tikhumporn Natvaratat, and former foreign rice trade director Akharaphong Teepwachara.

                      Of the 20 billion baht in compensation, Mr Boonsong is required to pay 1.77 billion baht and Mr Poom Sarapol has to pay 2.3 billion baht. The four others are required to pay 4 billion baht each.

                      They handled the rice sale contracts during the Yingluck Shinawatra government.

                      Mr Boonsong, along with 20 other individuals and companies, are already on trial in the Supreme Court over the G2G rice deals with two Chinese trading companies: Guangdong Stationery and Sporting Goods Import and Export, and Hainan Grain and Oil Industrial Trading Co.

                      The suit was filed after the National Anti-Corruption Commission found the foreign companies were not authorised by Beijing to make the deals.

                      Some local rice traders were allegedly actual beneficiaries. The rice under the G2G deals came from the grain the government collected under Ms Yingluck's rice-pledging scheme.

                      In September, Prime Minister Prayut Chan-o-cha invoked Section 44 of the interim constitution to give immunity to legal execution officials in handling demands for compensation for losses incurred by the Yingluck administration's rice-pledging scheme.

                      The government also ordered Ms Yingluck to pay 35.7 billion baht in compensation for her failure to stop the loss-ridden pledging scheme.

                      The Yingluck government launched the scheme in October 2011 to fulfil her Pheu Thai Party's election promise to farmers who are the party's voting base. The pledging prices was set at 40-50% higher than the market prices.

                            Court sets date to rule on 'fake' China rice sale

                            The Supreme Court has set Aug 25 as the date it will rule on a rice-trading case that emerged under the former government of Yingluck Shinawatra involving former commerce minister Boonsong Teriyapirom and 27 other individuals and juristic entities.

                            The date was set Wednesday after the court's Criminal Division for Political Office Holders finished examining a final batch of witnesses for the defendants, who were allegedly involved in bogus government-to-government (G2G) rice sales to China.

                            The suspects are accused of operating a fake G2G scheme worth 20 billion baht and selling state rice stockpiles cheaply to private Chinese firms by exploiting G2G privileges. These firms reportedly profited by re-selling the rice to a major local rice trader at higher prices.

                            Apart from Mr Boonsong, the defendants include former deputy commerce minister Poom Sarapol; Maj Veeravuth Watjanapukka; Mr Boonsong's former secretary, Suthee Cheumthaisong; and rice-trading tycoon Apichart "Sia Piang" Chansakulporn, an executive of Siam Indica Co.

                            They stand accused of colluding to commit offences and abusing their authority. In doing this they allegedly violated two laws -- the act on offences relating to the submission of contract bids to state agencies, and the organic act on counter-corruption.

                            Mr Boonsong's lawyer also introduced Su Chaoming, who works for a Chinese private law firm, as a witness at Wednesday's hearing.

                            Mr Su was hired to examine rice contracts between the Yingluck government and Guangdong Stationery & Sporting Goods Import & Export Corp and Hainan Grain & Oil Industrial Trading Co.

                            He said the Chinese government in 2003 changed the law so that all private companies have the same right to seek a quota to buy agricultural products from overseas, which is allocated by the central government.

                            The new law also allows them to sign contracts with foreign firms independently. Mr Su said this means the two companies named in this dispute were within their rights to deal with the Thai government directly, and report it to their local Chinese government later. Mr Su said he did not know if they had received quotas from either side.
