CSD arrests Banyin for tycoon's death

Police arrested former deputy commerce minister Banyin Tangpakorn in Nakhon Ratchasima on Tuesday for the alleged premeditated murder of construction tycoon Chuwong Sae Tang last year.

Crime Suppression Division (CSD) officers apprehended the 52-year-old politician at the Town Square Suite resort in the Khao Yai area of Pak Chong, where he was in the company of former stock broker Uracha Wachirakulton, a suspect in a related case. Ms Uracha, who is free on bail, was not charged.

Police obtained a warrant for his arrest from the Phra Khanong court in Bangkok on Monday on a charge of participating in premeditated murder to conceal another offence.

Police are interrogating Pol Lt Col Banyin, now retired. Pol Lt Col Banyin, a founding member of Thaksin's Thai Rak Thai Party, was deputy commerce minister in the short-lived Samak Sundaravej and Somchai Wongsawat Prachachon Party governments in 2008.

Shortly after the arrest, Wanpen Thanawamsiri, Chuwong's elder sister, and Sirirat Sae Tang, the victim's wife, visited the CSD.

Ms Wanpen expressed her thanks to police for their investigation, saying Pol Lt Col Banyin's arrest will help clear her brother's name.

Chuwong, the 50-year-old founder of major construction firm Standard Performance, was found dead in the front passenger seat of Pol Lt Col Banyin's vehicle after it hit a roadside tree in Prawet district, Bangkok, on June 26 last year.

Pol Lt Col Banyin was the driver.

The two men first met during a course at the National Defence College years ago.

Pol Lt Col Banyin and three women who knew him were earlier charged with stealing shares worth 260 million baht from Chuwong a short time before he was found dead. Police found documents had been forged to change the status of the share transactions from pledges against loans to transfers.

One of the women, Kanthana Siwathanapol, 27, was a model and claimed to be Chuwong's mistress and later gave birth to a child she said was his.

Another of the three women, Ms Uracha, was with Pol Lt Col Banyin at the time of his arrest. She earlier received Chuwong's shares through an account in the name of her 53-year-old mother, Srithana Promma, the third woman in the case. Ms Uracha also claimed to be Chuwong's mistress.

After learning of the transfers, Chuwong's family said they doubted the tycoon really died in the car crash.

Former deputy minister held on charge of premeditated killing of billionaire Chuwong in apparent 2015 car accident.

FORMER deputy commerce minister Banyin Tangpakorn was arrested at a luxury resort in Nakhon Ratchasima's Pak Chong district yesterday morning in relation to the death of billionaire Chuwong Saetang, a source revealed.

Banyin appeared indifferent and refused to speak to the media while escorted by police to the Crime Suppression Division (CSD) office in Bangkok for questioning.

Earlier yesterday, Central Investigation Bureau chief Thitirat Nonghanpithak had assigned a team led by CSD superintendent Colonel Jirapop Phuridej to arrest Banyin - who was found with former stock broker Uracha Wachirakulton, 26, at the resort.

His arrest was based on a warrant issued on Monday on a charge of premeditated murder and moves to conceal other crimes related to ill-gotten gains.

Thitirat quoted Banyin as saying that he would only testify in court, but police investigators said they had enough evidence to prosecute the former deputy minister, including CCTV footage.

He explained that police had so far found only one suspect in the case, saying investigators would continue to see if there were any other accomplices and proceed accordingly.

A police source revealed that the arrest warrant and subsequent detention of Banyin stemmed from the CSD, which had experts including university academics study and analyse the accident that led to Chuwong's death.

It also has reports from the Medical Council of Thailand on Chuwong's wounds and the autopsy report.

Construction tycoon Chuwong, 50, was found dead in the front passenger seat of a car driven by Banyin that hit a tree beside the road in Prawet district in Bangkok on June 26, 2015.

Chuwong's relatives' complained that the death was suspicious, given that shares worth Bt260 million had been transferred to two women, including Uracha, just days before his death.

Yesterday afternoon, Chuwong's sister Wanpen Thanathamsiri and his widow Sirirat Saetang visited the CSD office to thank the officers for arresting Banyin. Wanpen said the family was satisfied with the development after having to wait nearly a year for justice.

She also noted that it was obvious that Uracha, who is a suspect in the Chuwong share-transfer case, was close to Banyin. Uracha had previously claimed that she was close to Chuwong and did not know Banyin well.

Wanpen said her brother was accused of transferring shares to women out of affection, which was untrue because he did not have any questionable sexual affairs as previously reported. She claimed the motive for murder was greed for his shares, so people made up stories and killed Chuwong for fear that he would catch them for the crime. She said the late businessman's relatives were confident that more than one person had a hand in plotting the murder.

Sirirat said Chuwong's death allegedly at the hands of his friend Banyin should serve as a cautionary tale for others - they should check on a person's background before befriending them, even if they have a high position and status in society.

Police suspect Banyin in wife's 1991 death

Police are investigating the death of ex-deputy commerce minister Banyin Tangpakorn's former wife who was killed in a car crash 25 years ago. Pol Lt Col Banyin stands accused of murdering construction tycoon Chuwong Sae Tang in a possibly staged car crash last year.

A Crime Suppression Division (CSD) source said Pol Col Jirapob Puridet, chief of CSD subdivision 1, has assigned investigators to probe the death of , Pol Lt Col Banyin's former wife, who died in a car crash in Phayuha Khiri district, Nakhon Sawan, on March 23, 1991.

Pol Lt Col Banyin was a deputy inspector attached to a police station's traffic unit at that time.

The crash happened when Pol Lt Col Banyin and his wife, who was driving the car, were travelling back from dinner at a restaurant in Phayuha Khiri.

They were heading to Nakhon Sawan when a lorry cut in front of them, prompting the vehicle to veer to the side of the road and hit a tree.

Rosarin was badly hurt and rushed to Phayuha Khiri Hospital, where she was pronounced dead.

Investigators interviewed people close to Rosarin who said they doubted she had died because of the accident, the source said, adding those associated with Pol Lt Col Banyin's former wife supplied useful accounts. Officers are in the process of compiling information, the source noted.

Pol Lt Col Banyin has been charged with the premeditated murder of Chuwong.

The 50-year-old construction tycoon was found dead in the front passenger seat of Pol Lt Col Banyin's vehicle after it hit a tree in Prawet district, Bangkok, on June 26 last year. Pol Lt Col Banyin was the driver of the vehicle and escaped with minor injuries.

Banyin affair confirmed, victim's sister not surprised

A baby born to a woman linked to the theft of millions of baht in shares from Chuwong Sae Tang was fathered not by Chuwong but by the man accused of killing the former construction tycoon, a DNA test has confirmed.

The result comes as no surprise to Chuwong's sister, who said she was confident the test would clear her late brother. But it raises more questions about Banyin Tangpakorn, the retired policeman and former politician charged with the killing.

Wanpen Thanathamsiri, 54, on Friday expressed gratitude to Crime Suppression Division officers for helping to clear up one of the questions that had arisen since Chuwong, 50, died last year.

Mrs Wanpen also said she was watching her back as a suspect in the killing was now out on bail. She did not name Pol Lt Col Banyin but he was recently released on 2-million-baht bail after being charged with premeditated murder.

Mrs Wanpen, founder of the property development company Wealth Developer Co, met with police to discuss a defamation complaint that Pol Lt Col Banyin filed against her last September. At the time, he said she had accused him of asking Revenue Department officials to examine her company's books.

Pol Lt Col Banyin, 52, served as a deputy commerce minister in the short-lived governments of Samak Sundaravej and Somchai Wongsawat in 2008.

The former minister was arrested on June 28 at a resort in Nakhon Ratchasima with former stockbroker Uracha Vachirakulthol, 27. At the time he denied having a relationship with the woman and said she was just a golfing partner.

His wife Waraporn, 52, joined Ms Uracha in front of a pack of reporters on Tuesday and insisted that the younger woman was only a business partner of her children.

Police collected DNA samples from Ms Uracha's three-month-old baby during their search of her residence in Bangkok on Tuesday and a test reportedly showed the child was related to her and Pol Lt Col Banyin.

Ms Uracha's brother Chaiyaphan Vachirakulthol recently told police that Pol Lt Col Banyin had met her at her home at least four times.

Pol Lt Col Banyin, Ms Uracha, her mother and a former model were earlier charged with document forgery, share theft and receipt of stolen property in connection with the suspicious transfers of shares worth 263 million baht from Chuwong.

Police found that shares worth 35 million baht were transferred to Ms Uracha on June 8 last year. Another transfer worth 228 million baht was made two weeks later to former model Kanthana Siwathanapol, also 27.

Earlier the two women claimed to have been Chuwong's mistresses and Ms Kanthana said she had had a child with him.

When Pol Lt Col Banyin was arrested, Ms Uracha was driving a brand-new black Porsche Panamera. Police found that she and her mother had bought it with 6 million baht in cash on July 29, 2015, without having its ownership transferred.

Chuwong was found dead in Pol Lt Col Banyin's Lexus sport utility vehicle after it struck a roadside tree in Prawet district of Bangkok, on June 26 last year. Banyin, who was the driver, insisted they were friends and it was a fatal accident but police suspected he had Chuwong murdered and the accident was then set up to cover the crime.

The accident was similar to one in which Banyin's former wife Rosarin was found dead in their vehicle in Nakhon Sawan province 25 years ago.

The woman's family reportedly suspected the death as she did not know how to drive but local police reported she was the driver. Pol Lt Col Banyin, also a former Nakhon Sawan MP, was then a deputy traffic police inspector.

Raids target Chuwong suspects, alleged money launderer

Authorities on Saturday raided the homes of two women charged with stealing millions of baht in shares from the late construction tycoon Chuwong Sae Tang to gather more evidence to press their case.

In a separate operation, raids took place at two properties owned by a woman believed to be involved in money laundering linked to a major drug trafficking network.

The pre-dawn raids were carried out by a 200-member team of police commandos, forensic police officers and Anti-Money Laundering Office (Amlo) officials.

One of the homes targeted, at the Vista Park housing estate in the Ratchaphruek area, belongs to Kanthana Siwathanapol, 27, who faces charges of document forgery, share theft and receipt of stolen property in connection with transfers of shares worth 263 million baht from Chuwong.

Ms Kanthana, a model and caddie, earlier claimed to have been Chuwong's mistress and later gave birth to a child she said was his. The officers seized documents they believe are related to the share case and a Toyota Yaris car. The house has also been seized.

Officers then searched the house of Srithara Promma, 53, and her daughter Uracha Vachirakulthon, 27, at the Bangkok Boulevard housing estate on Rama IX Road. The two women are suspects in the same case with Ms Kanthana. Officers seized more evidence and the house.

The three women along with former politician Banyin Tanpakorn, have been charged with falsifying documents and share theft from Chuwong. Pol Lt Col Banyin is also charged with murdering Chuwong by staging a car accident.

Ms Uracha, a former stockbroker who handled Chuwong's trading account, also claimed to have been Chuwong's mistress. DNA tests have shown that Pol Lt Col Banyin was the father of a baby born to Ms Uracha.

The 50-year-old owner of the construction firm Standard Performance was found dead in a Lexus sport utility vehicle, driven by Pol Lt Col Banyin, on June 26 last year.

Pol Lt Col Banyin, who served as deputy commerce minister in the short-lived government of Samak Sundaravej, was arrested in Nakhon Ratchasima on June 28 and charged with premeditated murder.

In an earlier, unrelated raid, 100 officers, armed with a court warrant, descended on a two-storey house, situated on a 200-square-wah plot on Nawamin Soi 74 in Bung Kum district. The house belongs to Ms Anothai Chatwarangkul, who is suspected of being involved in money laundering linked to a drug trafficking network.

Police commandos showed the search warrant and used a megaphone to ask those inside the house to open the three-metre-high gate, but they refused.

After almost an hour of unsuccessful negotiations, an officer brandished a sledgehammer and prepared to break down the gate. At that point a housekeeper relented and opened it.

The housekeeper told the officers that the owner had left for Mae Sot district in Tak province. Only six migrant workers, including four men and two women, were inside the house.

The team searched the property and found two BMW sedans, a Toyota Fortuner and a Toyota pickup truck. Forensic officers and Amlo officials later searched the house for documents about links to the illicit drug trade.

Another team searched a one-storey house behind the main home in the compound. It served as an office and warehouse for storing goods.

THE ANTI-MONEY Laundering Office (AMLO) has frozen some assets of high-profile murder suspect Pol Lt-Colonel Banyin Tangpakorn, who allegedly embezzled hundreds of millions of baht from a now-dead friend via share manipulation. Imposed on August 10, the assets will be frozen for no more than 90 days.

Under the law, Banyin can petition against the freezing of his assets by submitting evidence to AMLO on how it had caused damage to him within 30 days after the order was promulgated in the Royal Gazette.

Banyin - a former deputy commerce minister - is now facing several charges related to the death and share deals of late construction tycoon Chuwong Saetang.

Last year, Chuwong was found dead in Banyin's car after the two finished a game of golf. Initially, it appeared as if the car had slammed into a tree, but emerging evidence pointed to possible foul play. Chuwong's family later learned that Banyin and some accomplices had transferred hundreds of millions of baht worth of Chuwong's shares. Investigators believe the share manipulation pointed to the fact that Banyin might have had a motivation to kill Chuwong.

Prosecutors split on whether Banyin and Ms Kanthana should be indicted in court

                        http://englishnews.thaipbs.or.th/pro...ndicted-court/

                        ___________

Prosecutors at odds on Chuwong shares theft case

A deputy attorney-general will decide whether to indict suspects in the alleged theft of 263-million-baht in shares from late construction tycoon Chuwong Sae Tang, as prosecutors cannot agree on the case.

Meanwhile, Chuwong's family say they are prepared to go it alone and bring charges in court.

Prayut Phetkhun, deputy spokesman of the Office of the Attorney-General, said on Monday that a prosecutor at the Department of Southern Bangkok Litigation who handled the share theft case had decided against indictment. However, a deputy director of the department believed the case was strong enough and supported indictment.

The department's spokesman Somnuek Siangkong said attorney-general Pongniwat Yuthapanboriparn had called for the investigators' case report and assigned a deputy attorney-general to make the decision.

If the deputy attorney-general supported indictment, the suspects would be arraigned in court. If not, the Office of the Attorney-General would ask the national police chief for his opinion.

If the police chief supported indictment, the attorney-general would make the final decision, Mr Somnuek said.

"The process is normal... It should not take a long time," he said.

Suspects in the share theft case are Banyin , 52-year-old former deputy commerce minister and Nakhon Sawan MP, former model Kanthana Siwathanapol, 26, former stock broker Uracha Wachirakulton, 27, and her mother Srithara Phromma, 52.

Police at the Crime Suppression Division charged them with theft, reception of stolen property and document forgery to facilitate share theft. Police also accused Mr Banyin of planning the murder of Chuwong, 50, to cover up the share theft.

The two men met during a course at the National Defence College years ago and remained friends.

On June 8 last year shares owned by Chuwong worth about 35 million baht were transferred to Ms Uracha who in turn transferred them to her mother. More shares worth 228 million baht were transferred to Ms Kanthana on June 22, four days before Chuwong's death. Ms Uracha and Ms Kanthana claimed they were Chuwong's mistresses.

According to police, Mr Banyin planned the murder of Chuwong before the securities firm routinely reported the share transfers to the tycoon at the end of June 2015.

On June 26 last year, he picked Chuwong up from his construction company Standard Performance in Lat Phrao area of Bangkok and took him to a golf course in Bang Na area.

On the way back to Chuwong's home, Mr Banyin took the victim to meet other people police have not identified.

Chuwong was killed by being hit on the head and face. He suffered multiple wounds, including a severe injury on the left side of his head. His neck was also broken by the assault.

Then the body was placed on the front passenger seat of Mr Banyin's vehicle with the safety belt left unfastened. Mr Banyin drove the vehicle into a eucalyptus tree 43 metres off the side of Chalerm Phra Kiat Rama IX Road in Prawet district, trying to make it appear like a fatal accident to conceal the crime, police allege.

The former deputy commerce minister was arrested in Nakhon Ratchasima province on June 28 for the alleged premeditated murder and on the following day was released on bail of 2 million baht on the condition that he must not leave the country without court permission and must report in every 12 days.

Sirirat Sae Tang, Chuwong's elder sister, and Wanpen Thanathamsiri, Chuwong's wife, on Monday sent a petition to the attorney-general for fair treatment in the alleged murder case.

Their lawyer Anek Khamchum said if public prosecutors indicted the suspects on the share case, the family would seek to be listed as a co-plaintiff. If prosecutors decided not to indict, the family would press its own lawsuit.

                            • Banyin denies charges on disappearance of judge's brother/Court sends evidence to police

Banyin Tangpakorn has denied two new charges pressed against him by police after the former MP for Nakhon Sawan was arrested at his house on Sunday morning.

"I still do not know what this is all about," the former deputy commerce minister told reporters as he walked into the Crime Suppression Division (CSD) in the afternoon with police escorting him.

Central Investigation Bureau (CIB) chief Pol Lt Gen Suthin Sapphuang said later the former politician has been charged with colluding with others on murder and ransom in relation to the disappearance of Veerachai Sakunprasert. The body of the missing person has not been found.

The CSD is a unit under the CIB.

Mr Veerachai is the elder brother of judge Panida Sakunprasert, who is in charge of the case in which Pol Lt Col Banyin has been indicted for falsifying a share-transfer document.

Pol Lt Col Banyin, 56, was arrested by the CSD special force Hanuman at his house in Muang district of Nakhon Sawan on Sunday morning. Police then took him to the CSD for interrogation and charges. Police also arrested two other suspects identified only as Mr Manas, 67, and Mr Narongsak, 49. All were wanted under arrest warrants issued by the Criminal Court on Feb 19.

Judge Panida is due to deliver the ruling on the case at the South Criminal Court on March 20. The case involves fake documents used to transfer about 300 million baht in shares to the former deputy commerce minister from late construction Chuwong sae Tang in 2015.

Police believed the abduction of the judge's brother is directly connected with the case.

                            Plot and threats

Court of Justice secretary-general Sarawut Benjakul spoke out on Sunday about the case, saying CCTV cameras had captured the suspects waiting for one hour before they abducted Mr Veerachai at the South Criminal Court on Feb 4. He said at least three people were seen, but refused to say whether one of them was Pol Lt Col Banyin.

The abductors took Mr Veerachai to a waiting vehicle at 5.30pm on Feb 4.

CSD police said one of the suspects called judge Panida by phone, pressing her to dismiss the defendant's case when the ruling is delivered in exchange for the release of her brother. If she failed to heed the threat, his brother would "go missing", the police said.

The judge later filed a complaint over the threat to her life with police, including the recorded conversation between her and the caller.

"The abduction of a hostage to affect the court ruling is serious and is unprecedented in the Court of Justice," Mr Sarawut said. Judge Panida is under the protection of the police and court marshals, he added.

It remains unclear why Mr Veerachai was at the court that day.

Police believe he was murdered after the judge refused to comply.

                            Killing spots

Police tracked the abductors after the judge sought help from them before requesting the court approve the arrest warrants for the three.

The body of Mr Veerachai was believed to have been burnt and dismembered in Takhli district of Nakhon Sawan, before the body parts were put in bags and dropped into the Chao Phraya River in Muang district, according to the CSD.

National police chief Chakthip Chaijinda flew to the province on Sunday to examine the evidence. He went to Ban Kradee in Takhi district -- where the brother of the judge was believed to have been slain -- and then to Ban Klang Daed in Muang district where the bags were dumped.

Pol Gen Chakthip ordered divers to quickly search for the bags in order to use them to substantiate the allegations involving at least three other suspects besides Pol Lt Col Banyin.

Police also searched 19 locations in Nakhon Sawan and two in Bangkok on Sunday as part of the investigation.

                            Daughter's reaction

Bussaya, a daughter of the former politician, followed her father to the CSD and called for justice for her family.

She said she was confident in her father's innocence and said he could have been framed by his enemies.: https://www.bangkokpost.com/thailand...judges-brother
