      Prime Minister Prayut Chan-o-cha says he will "take responsibility" for the dispute with an Australian company involving a gold mine he shut down three years ago, but has yet to make the decision.

      At the cabinet meeting on Tuesday, Energy Minister Suriya Jungrungreangkit reported the progress of the arbitration between Kingsgate Consolidated and Thailand that began in late 2017.

      The Chatree mine in Phichit and Phetchabun provinces, operated by the Kingsgate subsidiary Akara Resources Plc, was ordered to suspend production in late 2016 on grounds that its activities were harmful to the environment and area residents' health.

      The order was made by Gen Prayut under Section 44 of the interim constitution, which grants him unlimited executive powers with impunity after the 2014 military coup.

      Kingsgate has consistently disputed the findings of reports that its activities resulted in toxic leaks that affected groundwater and local paddy fields.

      Kingsgate has since entered into an arbitration process with Thailand under the Thailand-Australia Free Trade Agreement (Tafta). The company said the government's order was unlawful under the trade pact and caused substantial damages.

      On Tuesday, the Energy Ministry proposed four options to the cabinet: (1) paying Akara Resources to shut it down; (2) complying with Akara's demands to avoid paying; (3) waiting for the ruling of the arbitrator and abiding by it; and (4) partially paying the damages and then allowing the mine to reopen.

      Some ministers did not agree with the last option, viewing if the government had already shut down the mine, it would be inappropriate to allow it to reopen.

      While the meeting was discussing the issue, Gen Prayut said he needed time to think. "I can't decide now but I'll bear all the responsibility," he said.

      Interior Minister Anupong Paochinda said Thailand should wait for the ruling while Finance Minister Somkid Jatusripitak made no comments.

      Chatree was Thailand's biggest gold mine, employing almost 1,000 workers. The open-cut mine began production in 2001. Its concession was due to run until 2028.

      Since Gen Prayut used his special power to shut it down, a question followed who should pay the damages, believed to be 36 billion baht, should the arbitrator decide in Kingsgate's favour.

      They link the Chatree case with the status of Gen Prayut as "state official". In their view, if Gen Prayut is a state official, the Thai government must pay the Australian company. But if he is not, Gen Prayut should pay the claims out of his own pocket.

      The status of Gen Prayut was questioned before he became the prime minister after the March 24 election. The charter says a prime minister must not be a "state official". Some people believed Gen Prayut was a state official because he received salaries from the state and asked the Constitutional Court to rule.

      The court decided Gen Prayut was not a state official. As the holder of the sovereign power at the time, he was not a state official and was qualified to be prime minister.

      • Prayut lauds role of legislation in cybersecurity


      The government is trying to develop Thailand's defences against cybersecurity threats, including through legislation, says Prime Minister Prayut Chan-o-cha.

      Gen Prayut was speaking at the opening ceremony of Digital Thailand Big Bang 2019 symposium on Monday at Bitec Bangna.

      He said cyber-attacks are "a new form of threat" and terrorists are exploiting digital technology to support their activities.

      "Everyone must pay attention to this issue, which is why the government is preparing, including through the newly enacted Cybersecurity Act and Personal Data Protection Act," said Gen Prayut.

      The government wants to see seamless connectivity in digital transformation between the state and private and public sectors. The Thailand 4.0 policy focuses on the adoption of advanced and digital technologies such as big data to develop human capital, society and key business segments, he said.

      Digital transformation is expected to drive Asean's average annual income per person to US$100,000 (3.02 million baht) by 2025, and Thailand stands to benefit from it, said Gen Prayut.

            An additional stimulus package could be launched later this year to invigorate the economy after the third-quarter reading was weaker than expected.

            The economic cabinet chaired by Prime Minister Prayut Chan-o-cha yesterday acknowledged that the third-quarter economic growth reading was softer than expected, said Kobsak Pootrakool, deputy secretary-general to the prime minister for political affairs.

            For the third quarter, government spending, tourism and exports picked up, while private investment, particularly in some industrial sectors, remained tepid, he said.

            But the two phases of the Taste-Shop-Spend scheme, which offered a 1,000-cash handout and 15-20% cash rebate for spending outside home provinces, were not taken into account. The scheme started in late September.

            "The government is waiting for the National Economic and Social Development Council (NESDC) announcement on third-quarter economic figures, scheduled for Nov 18," Mr Kobsak said. "The economic cabinet's next meeting is scheduled for Nov 22."

            The Bank of Thailand recently projected economic growth in the third quarter of 2.9% after gains of 2.8% in the second and 2.3% in the first. The figure was below the central bank's expectations.

            Both the central bank and Fiscal Policy Office downgraded their growth outlook this year to 2.8%, though the government hopes stimulus measures will boost growth to 3%.

            "The economic cabinet authorised related agencies to prepare in advance for additional stimulus measures in case they are needed," Mr Kobsak said. "The package will be ready at the next economic cabinet meeting."

            Deputy Prime Minister Somkid Jatusripitak said earlier this week that a third phase of the Taste-Shop-Spend scheme is likely, while Finance Minister Uttama Savanayana said it would take a month to assess whether a third phase is needed.

            Property measures

            Charnkitt Dejvitak, vice-minister to the prime minister, said after a meeting with the private sector about property stimulus that the government had agreed to propose Mr Uttama talk with the central bank about easing the loan-to-value curbs by allowing 100% mortgages to be applicable to subsequent housing loans, in addition to first mortgages now.

            The government's latest property stimulus and GH Bank's 50-billion-baht in low-interest loans are expected to help property developers release 35,000 unsold residential units from their inventories.

            If the forecast holds true, real estate sales should grow 5-7% next year.

            The government last month approved the new property stimulus package consisting of a property transfer fee cut to 0.01% from 2% and mortgage fee reduction to 0.01% from 1%.                 Prayut pushes for seamless Malaysia border


                Thailand and Malaysia have agreed to push for seamless transport of overland cargo across the southern border, according to government spokeswoman Narumon Pinyosinwat.

                Prime Minister Prayut Chan-o-cha met with Malaysian counterpart Mahathir Mohamad on the sidelines of the 35th Asean Summit and Related Summits on Saturday, where both agreed on plans to facilitate goods traffic at the border.

                An agreement was made to improve border infrastructure and work towards signing an MoU on cross-border freight transport, which will contribute to seamless connectivity between Bangkok, Penang, Johor Bahru and Singapore.

                Gen Prayut hoped Malaysia will allow more imports from Thailand, to help raise people's income in the southern provinces, said Ms Narumon. The two countries will also work together to combat the smuggling of contraband goods along their common border.

                Dr Mahathir, meanwhile, congratulated Gen Prayut on the success of Thailand's Asean chairmanship this year.

                Gen Prayut took the opportunity to thank Malaysia's government for inviting the Thai delegation for peace talks in the deep South and for supporting Thai efforts to restore peace in the border provinces.

                            Prayut asks US to reconsider trade preferences cut


                            Thailand has asked the United States to reconsider Washington's decision to cut some Thai products from its list of low-tariff imports under the Generalized System of Preferences.

                            Prime Minister Prayut Chan-o-cha raised Thai concerns about the decision in talks with US Commerce Secretary Wilbur Ross on the sidelines of the Asean Summit on Sunday, the government said in a statement.

                            Gen Prayut said the cut, to take effect early next year, will affect the private sector and the pubic. He said he had asked the US to reconsider the decision since the two countries are close allies.

                            The US announced on Oct 25 the planned suspension of $1.3 billion (39.2 billion baht) in trade preferences, ostensibly because of failure to curb labour abuses in the fishery industry.
