    Jatuporn sentenced two years in prison with no abstention

    The Criminal Court today sentenced Jatuporn Promphan, leader of the redshirt United Front for Democracy against Dictatorship, two years in prison after finding him guilty of defaming former prime minister Abhisit Vejjajiva in October 2009.

    The court handed the imprisonment term with no abstention when he accused the former premier of ordering the suppression of protesters while addressing a gathering of anti-government protest on October 11, 2009 at the Democracy Monument.

    The court also found that his accusation that the former premier Abhisit had attempted to delay submission of the amnesty bill for royal approval for fugitive premier Thaksin Shinawatra was false and would merely defame his reputation.

    Jatuporn was consulting his lawyer to pose 200,000 baht in asset as bail for temporary release.

    His lawyer was also considering to appeal the sentence to the Appeals Court.

    Thai `Red Shirt` leader sentenced to two years in jail

    Bangkok: A Thai court Wednesday sentenced the leader of the opposition Red Shirt movement to two years in prison for defaming a former premier, a move analysts said was the latest attack against critics of the military regime.

    The ruling comes days after the retroactive impeachment and announcement of corruption charges against ex-prime minister Yingluck Shinawatra, whose toppled government was backed by the Red Shirts before May`s army coup.

    The court convicted Red Shirts chairman Jatuporn Prompan on two counts of defamation against former royalist prime minister Abhisit Vejjajiva during speeches he made in October 2009.

    "The verdict is two years in prison without suspension," a court official told AFP.

    Jatuporn`s lawyer Winyat Chatmontree confirmed the sentencing, saying his client -- who was accused of defamation for holding Abhisit responsible for a crackdown against protesters in 2009 -- would not be imprisoned until the conclusion of his appeal.

    "The court has approved bail, after this we will submit an appeal," he told AFP.

    Anti-coup voices -- including lawmakers from Yingluck`s former ruling Puea Thai party, academics and students` groups -- have been silenced after the army outlawed political gatherings, briefly summoned dissenters and censored the media.

    The once mighty Red Shirts have gone to ground with Jatuporn one of their few public faces, back on the small screen after the junta lifted a ban on political TV channels despite his every word coming under close scrutiny by authorities.

    The firebrand leader has swapped his once rabble-rousing rhetoric for cautionary language, urging followers against taking to the streets after last Friday`s decision against Yingluck.Jatuporn, a former Puea Thai MP, has faced a slew of court cases in recent years. In August 2013 he was cleared of slandering Abhisit in a separate probe.

    Thailand analyst David Streckfuss told AFP Wednesday`s ruling was the latest attempt to quash any opposition to the military regime.

    "It seems to be part of a larger plan by the Bangkok establishment to silence and force aside their vocal critics," he said, adding it was rare for someone to face jail time over criminal defamation, with suspended sentences more common.

    Thailand`s long-running political conflict broadly pits Bangkok`s middle-class and royalist elites, backed by parts of the military, against rural and working-class voters loyal to Yingluck`s older brother and former prime minister Thaksin Shinawatra.

    Parties led by or aligned to Thaksin, who lives in self-exile to avoid jail for a corruption conviction, have won every election in Thailand since 2001.

    Streckfuss said the recent rulings against Yingluck and Jatuporn pointed to a "step-by-step dismantling of the Red Shirt and Pheu Thai leadership".

    "They are attempting to weaken the infrastructure of pro-democracy forces ahead of when an election is eventually held," he said.

    Junta chief and premier Prayut Chan-O-Cha has said the army takeover was necessary to end months of political unrest that left nearly 30 people dead.

    He initially said fresh polls would be held around October this year, but the appointed government`s officials have since said an election will be delayed until at least early 2016.

    Yingluck`s impeachment by a junta-stacked parliament has seen her face an automatic five-year ban from politics. She had already been forced out of office in a controversial court ruling before the military`s coup.

    The same day she was impeached, prosecutors announced corruption charges that could see her face a decade in jail.

        Jail term for Thai red-shirt leader Jatuporn Prompan

        One of the main leaders of Thailand's "red-shirt" movement has been handed a two-year jail term for insulting a former prime minister.

        Jatuporn Prompan was convicted of defaming Abhisit Vejjajiva during two speeches in 2009.

        He was freed on bail and is expected to appeal against the conviction.

        Mr Jatuporn was an MP in the party of former Prime Minister Yingluck Shinawatra, who was banned from politics for five years last week.

                    Top court affirms ruling over arson fire


                    The Supreme Court on Wednesday ordered three United Front for Democracy against Dictatorship (UDD) movement co-leaders, Jatuporn Prompan, Nattawut Saikuar and Weng Tojirakarn, to pay more than 21 million baht in damages plus interest for an arson attack on a building near the Victory Monument in Bangkok during the red-shirt protests in 2010.

                    Prasong Kangwanwattha, the plaintiff filing for damages, told the court his commercial building suffered damage from the fire, which destroyed the nearby CentreOne department store and a branch of Dok Ya bookstore at the Victory Monument, as red-shirt protesters were being dispersed by security forces on May 19, 2010.

                    Originally, 10 defendants were named in the suit, including former prime minister and then-Democrat leader Abhisit Vejjajiva; former deputy prime minister Suthep Thaugsuban; former interior minister Chavarat Charnvirakul; Gen Prawit Wongsuwon, who was then defence minister; and Bangkok Union Insurance Plc.

                    The court, in the first instance, acquitted all defendants. The plaintiff then appealed the ruling, and the Appeal Court ordered the three UDD co-leaders to pay 30.5 million baht plus 7.5% interest in damages. They were also ordered to pay 638,710 baht in compensation for losses which the plaintiff suffered after his building was damaged by the fire -- a decision which they appealed.

                    The Supreme Court on Wednesday decided to lower the amount to 21.35 million baht plus 7.5% interest, and ordered the trio to pay 100,000 baht in compensation for the plaintiff's lost benefits per month until they pay off all court-ordered payments.

                    Meanwhile, the prosecution on Wednesday indicted two more supporters of the now-defunct People's Democratic Reform Committee (PDRC) on eight charges -- including insurrection -- for their role in street protests against the Pheu Thai-led government in 2013-14.

                    Prayuth Phetchakhun, deputy spokesman for the Office of the Attorney-General (OAG), said Uthai Yodmanee, a former leader of the Network of Students and People for Reform of Thailand (NSPRT), and Nasser Yeema, chief of the NSPRT guards, were taken to the Criminal Court where they were formally charged with insurrection, illegal assembly, instigation of strikes, and obstructing an election.
