Pro-Democracy Activists File Assault Charges Against Police, Soldiers
    25 June 2015

The seven pro-democracy activists who filed a complaint against security officers after a seven hour stand-off outside Pathumwan Police Station in Bangkok, 24 June 2015.

BANGKOKRangsiman Rome, 22, flashing the anti-coup three-finger salute outside of Pathumwan Police Station, 24 June 2015.

The charges filed by the activists are largely symbolic, as security officers are exempted from any legal prosecution if a martial court deems their actions "not excessive" and committed within "sincere intention," according to an order issued by junta leader Prayuth Chan-ocha on 2 April.

Despite photographic evidence of the forceful crackdown, leading government officials have also denied that security officers acted excessively.

Of the nine people charged in connection with the 22 May demonstration, one reported to police voluntarily on 22 June. Chartchai Kaedum, who had campaigned against the former government toppled by the current junta, said he was only observing the protest, and was mistaken as an activist by a plain-clothed army officer.

Another suspect, Nachacha Kongudom, was arrested at a hospital yesterday morning, where she was being treated for tonsilitis. She was taken to martial court and granted bail on the condition that she does not join any political activities.

Kritsadang Nutcharus, a lawyer who represented Nachacha and the seven activists at Pathumwan Station last night, has argued that the 22 May demonstration was a lawful expression of opinion.

"The authorities should open their hearts and listen to the activists, instead of suppressing different opinions," Kritsadang said.

Kritsadang also criticized the decision to issue arrest warrants on the seven activists for failing to surrender themselves before the 19 June deadline given by police. According to Kritsadang, the activists were unable to report to police on 19 June, and had announced their intention to report on 24 June, but police ignored their request for a postponement.

"I'd like to ask the officers to repeal these arrest warrants, because the action of these young people are simply symbolic," Kritsadang said. "The officers should talk to the activists and reach some understanding."

Rangsiman, one of the seven activists, told reporters he believes the police are attempting to "politically bully" him and his friends. He also accused the police of lying to the activists on the night of 22 May by reportedly saying they would not face any charges.

"We asked the police to release us without any condition, and the police agreed and promised they wouldn't file charges," Rangsiman said. "But they ended up charging us and issuing arrest warrants later."

He also told the media yesterday, "Let me repeat that we were not here today to surrender ourselves, but to file charges against the police for assaulting us when they arrested us. We resolutely reject any form of dictatorial power of the government and the security officers."

Thai police charge 14 student activists with 'sedition': lawyer

Thai police charge 14 student activists with 'sedition': lawyer

Bangkok (AFP) - Thai police Friday charged 14 students with "sedition", a lawyer said, which could see them jailed for seven years, after they staged a peaceful rally against the ruling junta's sweeping curbs on civil liberties. The pro-democracy campaigners from universities in Bangkok and the country's northeast are among the few public faces of dissent that remain in Thailand since the military seized power last year.

The severe charges follow a peaceful protest at the capital's Democracy Monument Thursday when the students made impassioned speeches and sang songs urging an end to junta rule, cheered on by dozens of supporters.

Police unusually held back from the rally, which also drew dozens of journalists, but arrested the students late Friday afternoon, hours after they encircled a house where they had been seeking refuge from arrest.

Pawinee Chumsri, a lawyer representing some of the activists, told AFP they were each charged with "sedition" under section 116 of Thailand's criminal code, an offence that carries up to seven years in jail.

She previously understood they would be charged for illegal assembly -- political gatherings and criticism of the junta are banned under the regime -- an offence carrying a lesser penalty of up to six months in prison and a fine of 10,000 baht (US$300).

"The 14 students have now been charged with article 116 which carries up to seven years in prison," Pawinee said, adding that they would likely be taken to the capital's military court and imprisoned later Friday.

Thai police did not immediately respond to an AFP request to confirm the charges.

The students arrested Friday -- part of groups staging small but symbolic acts of protest against the military regime -- had been involved in anti-coup protests last month marking one year since the army takeover.

Those protests in Bangkok were quashed when police dragged away and held overnight dozens of students at the protest in angry scenes.

Seven of the 14 arrested study in the northeastern city of Khon Kaen. They also staged an anti-coup rally last month and have been dubbed the "Magnificent Seven" on social media.

On Wednesday, one of the Bangkok activists from last month was charged with illegal assembly for that protest. The students charged Friday had also gathered at a downtown police station to register their complaints against maltreatment by authorities in May.

Thailand's generals claim the May 2014 coup was essential to restore order to the country after months of often violent protests against the elected government of Yingluck Shinawatra.

But opponents say it was the latest manoeuvre by Bangkok-based royalist elites, backed by large swathes of the military, to scupper democracy in the kingdom.

The Thai army commander said that the arrest of 14 embattled anti-junta student activists was unavoidable to prevent further conflicts and warned that people involved with the student activists will face tough measures.

According to Thai News Agency, Gen Udomdech Sitabutr, the Commander of the Thai Army and Deputy Defense Minister, said on Saturday that the arrest of 14 anti-junta student activists was necessary to prevent further conflicts in the nation.

He warned that the security officers now know who are behind the student movements and that people who are involved in supporting the student activists will face harsh measures from the authorities.

The army chief pointed out the the 14 student activists who are now under detention allegedly breached Article 116 of the Thai Penal Code and that they, including, the accomplishers of their anti-junta activities will be punished in accordance to Article 83 on the principles and accomplishers of crimes.

GROUP OF 53 ACADEMICS AND ACTIVISTS DEMANDS THAT THE JUNTA FREE 14 ANTI-COUP DETAINEES AND CALLS FOR PUBLIC SUPPORT

A GROUP of leading academics and activists yesterday demanded that 14 arrested student activists be immediately released and called on the public to stand up to the junta.

The group of 53 academics and activists, calling themselves People Behind the Neo Democracy Movement, issued a statement to demand that the National Council for Peace and Order (NCPO) return power to the people.

Earlier yesterday, Deputy Defence Minister General Udomdej Sitabutr threatened to take action against those behind the anti-government movement led by the Neo Democracy Movement (NDM), the group the 14 arrested students belong to, which consists mainly of university students.

More than 50 political activists and prominent academics gathered at Suan Ngern Mee Ma, a training centre that served as a shelter for the student activists before their arrest on Friday.

In a statement, the scholars and activists identified themselves as supporters of the arrested students, emphasised their stance in opposing what they labelled a dictatorship and the "selfishness and ineffectiveness" of Prime Minister Prayut Chan-o-cha.

The statement was signed by all 53 members of the group. The most prominent among them are social critic Sulak Sivaraksa, political scientist Kasian Tejapira, former Thammasat University rector Charnvit Kasetsiri, and noted writer Suchat Sawatsri.

Sulak and Suchat were also present during a press conference yesterday to announce the group's stance.

Other signatories to the statement include Chulalongkorn University political scientist Puangthong Pawakapan, Thammasat University anthologist Yukti Mukdavijit, political scientist Pongkwan Sawasdipakdi, and Same Sky magazine editor Thanapol Eiwsakul.

"What kind of society is the NCPO leading Thailand to? Calls for democracy and justice using non-violence have become criminalised," their statement said.

                'Scared of opponents' opinions'

The student group had earlier denied a claim by the authorities that political groups were behind their moves.

"Prayut's administration is scared of opponents' opinions because they are well aware that they can't run the country," the group said.

"They are not capable of solving problems. But they persist to stay to preserve their own power and interests amid the national calamity."

It urged people to come out and call on the junta to return their power, adding that PrayutPrayut meant when he said a political group was behind the anti-coup group. He urged the government to substantiate the allegation with proof.

"If the PM has proof, please clearly identify who they are because people who are not involved may be perceived by society with suspicion. Do not generalise because it may spark something big," he said.

BANGKOK, June 30 (Reuters) - The United Nations and European Union on Tuesday urged Thailand to release 14 students arrested for holding peaceful demonstrations against the country's military government, but the leader of the junta remained unmoved.

Prime Minister Prayuth Chan-ocha, the general who led the coup against an elected government last May, said he would not bow to international pressure.

The 14 students that were arrested on Friday for holding several demonstrations are part of a network of pro-democracy groups that have held demonstrations in Bangkok and other provinces.

They had also participated in a protest to mark the first anniversary of the coup on May 22. Police arrested 40 students during that protest, but subsequently released them all. Prayuth voiced impatience that some had continued to protest.

"Thai law is Thai law. I gave these students a chance," the leader of the junta told reporters.

The students have been charged with sedition, a national security offense, and could face up to seven years in prison if a military court finds them guilty.

The junta, which calls itself the National Council for Peace and Order, has banned public gatherings.

The United Nations Human Rights Office for Southeast Asia (OHCHR) issued a statement urging Thailand to promptly drop the charges.
The EU called the arrests a "disturbing development".

The 2014 coup ousted the government of Prime Minister Yingluck Shinawatra.

Thailand has been divided for a decade between the country's traditional establishment in the capital and the south supporters of Yingluck and her brother, former Prime Minister Thaksin Shinawatra, who was himself ousted by the army in 2006.

The students are being held at a Bangkok prison where dozens of relatives and friends gathered on Tuesday.

Some held Post-it notes that read: We don't want military courts. Others shouted "fight, fight".

Wiboon Boonpatararaksa, 59, the father of one of the jailed students, said he came to give his son encouragement.

"What he and his friends did was of their own initiative and we will stand by them," he said.
