    Murder charge likely for Banyin in shares case


    The Crime Suppression Division is pressing a murder charge against former deputy commerce minister Banyin Tangpakorn and five other suspects in connection to the killing of a senior judge's brother.

    Pol Col Anek Taosupab, deputy chief of the CSD, said investigators plan to question Banyin in prison over the murder of Wirachai Sakuntaprasoet, brother of Criminal Court senior judge Phanida Sakuntaprasoet.

    Banyin is incarcerated at the Bangkok Remand Prison, where he is serving time for forging documents to transfer 263 million baht worth of shares to two associates.

    The court found Banyin guilty of colluding with Kanthana Siwathanapol, a former golf caddie, and stockbroker Uracha Wachirakulton to transfer the assets of the late billionaire contractor Chuwong Sae Tang.

    The suspects allegedly tried to force judge Phanida to drop Banyin's indictment in the share transfer case.

    The CSD said it has evidence, including forensic test results, to lay the murder charge against Banyin and the five other suspects.

    According to a report, judge Phanida asked Mr Wirachai to pick her up from work after she was assigned to hear Banyin's forgery case when the victim was kidnapped and killed.

    The case was then re-assigned to another judge and the trial ended with Banyin sentenced to eight years in prison for forgery.

      Murder charges filed against Banyin, five others


      The prosecution has filed indictments with the Central Criminal Court for Corruption and Misconduct Cases against former deputy commerce minister Banyin Tangpakorn and five co-accused for the murder of an elder brother of a Bangkok South Criminal Court judge in February, Office of the Attorney General spokesman Prayuth Phetkhun said on Monday.

      Mr Prayuth said the case was filed on Monday after Jessada Arunchaipirom, director-general of the Department of Corruption Litigation, and his deputy Siriya Intamara agreed with a recommendation by a working committee handling the case that the six suspects be arraigned on six charges.

      The charges stem from the abduction and murder of Wirachai Sakuntaprasoet, the elder brother of Bangkok South Criminal Court judge Phanida Sakuntaprasoet, allegedly as part of a plot to force her to drop an indictment against Pol Lt Col Banyin in a case involving the fraudulent transfer of a huge number of shares.

      Wirachai was kidnapped by four men outside the court on Feb 4. The 70-year-old was later killed and his body burned and the remains tossed into the Chao Phraya River in Nakhon Sawan.

      Pol Lt Col Banyin and the five other suspects - Manat Thapnin, Narongsak Pomchan, Chatchai Menkun, Prachawit Sithongsuk and Pol Senior Sgt Maj Thongchai Wachisatcha - are accused of the kidnapping and murder of Wirachai.

      The six are charged with premeditated murder, conspiracy to detain a person resulting in his death, threatening a state official, illegal assembly, demanding a ransom and abduction.

      Pol Lt Col Banyin is additionally charged with illegally wearing a police uniform during the abduction.

      The prosecution decided not to indict a seventh, unnamed suspect in this case for lack of evidence.

      Mr Prayuth said the prosecution asked the Central Criminal Court for Corruption and Misconduct Cases to combine whatever penalty is handed down on Pol Lt Col Banyin in this case with the eight years' jail sentence given him in March by the Bangkok South Criminal Court. In that case he was found guilty of forging documents to set up the transfer of 300 million baht worth of shares owned by his friend, businessman Chuwong Sae Tang, to himself and two accomplices.

      The prosecution also asked the court to combine the penalty in the Wirachai murder case with whatever penalty is handed down on Pol Lt Col Banyin by the Phra Khanong Criminal Court in another case. He is charged with murdering Chuwong Sae Tang, the owner of the shares in the previous case. This case is still before the Phra Khanong Criminal Court.

        Banyin pleads not guilty to abduction-murder of judge's brother


        Former deputy commerce minister Banyin Tangpakorn and four co-defendants have pleaded not guilty to the abduction and murder of the elder brother of the judge handling his multi-million-baht stock theft case.

        They entered their pleas via video conference from behind bars during their arraignment in the Central Criminal Court for Corruption and Misconduct Cases on Friday.

        The six accused in the case are being detained at Bangkok Remand Prison, including Banyin, 56. They face charges relating to the death of Weerachai Sakuntaprasoet, 67, early this year.

        In February, prosecuitors charged each of them with premeditated murder, fatal detention, coercing others, illegal assembly and concealing a body.

        The other defendants are Manat Thaptim, 67, Narongsak Pomchan, 48, Chatchai Menkun, 31, Prachawit Sithongsuk, 33, and Pol Snr Sgt Maj Thongchai Wachisatcha, 63. All are natives of Nakhon Sawan province.

        Five of the defendants pleaded not guilty to the charges. Mr Narongsak pleaded guilty. The court adjourned the hearing until next month, when evidence and witness lists will be considered.

        Banyin and his five co-defendants allegedly abducted and ultimately murdered the elder brother of Bangkok South Criminal Court judge Phanida Sakuntaprasoet, to pressure her to drop charges in a 300-million-baht stock fraud case against Banyin.

        Weerachai was kidnapped outside the court on Feb 4 and bundled into a van. He is believed to have been killed on or about Feb 5. The victim's body was burnt and the remains tossed into the Chao Phraya River in Nakhon Sawan.

        Banyin is additionally charged with illegally wearing a police uniform during the abduction.

        Banyin was subsequently found guilty of forging documents to set up the transfer of 300 million baht's worth of shares owned by his 50-year-old friend, construction tycoon Chuwong sae Tang, to himself and two accomplices.

        Banyin has also been charged with murdering Chuwong in 2015.

            Thailand’s former deputy commerce minister, Banyin Tangphaporn, tried to commit suicide while on remand at Bang Khwang maximum security prison last Friday, after prison officials uncovered alleged plots to kidnap the wife of the prison warden to hold hostage in return for his release and to escape while being taken to the court next Monday, if the first plan failed.

            Informed sources in the Corrections Department said that officials managed to intervene and save Banyin as he tried to hang himself in his cell.

            The sources said that Banyin was transferred from Bangkok special prison to Bang Khwang after officials learned that he had allegedly hired a former inmate to kidnap the wife of the warden of Bangkok special prison in Lampang province.

            If the plot did not work out, the former inmate and accomplices would try to seize Banyin as he is escorted from prison to court for a hearing on June 22nd, said the sources.

            The Crime Suppression Division were asked, by the unidentified prison warden, to track down the former inmate. He was eventually caught and revealed the entire plot to authorities. This resulted in Banyin being moved to Bang Khwang prison and he eventually tried to commit suicide, said prison officials.

            While on remand in Bangkok special prison, pending trial on a murder case, officials said that Banyin had asked for privileges and to be transferred to more comfortable zone. He also demanded that prison officials not record his conversations with visitors.

            Banyin and two other accomplices were each sentenced to eight years for falsifying official documents and using them to take ownership of more than 300 million baht in shares, belonging to a construction businessman, Mr. Chuwong sae Tang.

            He is also alleged to have ordered the abduction of the brother of Judge Ms. Panida Sakuntaprasert, who was in charge of the illegal share transfer case, to bargain for light sentence, but Judge Panida rejected the demand.

            The judge’s brother was later found dead, believed killed by men hired by Banyin.

              Banyin’s son denies links to prison break plan

              The son of disgraced former government official Banyin Tangpakorn has denied any involvement in his father’s alleged plan to break from Bangkok Remand Prison.

              Banyin, former deputy commerce minister, was convicted over a forgery charge and has been accused of being involved in the abduction and murder of a Bangkok South Criminal Court Judge's elder brother.

              He was placed in solitary confinement last month at Bang Kwang Central Prison in Nonthaburi after reports of an escape plan allegedly involving multiple people surfaced.

              Woraphat Tangpakorn, son of Banyin, showed up for questioning at the Crime Suppression Division (CSD) headquarters in Bangkok on Thursday after he was summoned by Pol Col Sanphet Nuthong, superintendent of the CSD investigation unit.

              Mr Woraphat was summoned after police learned he was a close friend of Natthapol “Top” Norakarn, 30, who served under Banyin’s command when he still had his police rank.

              Natthapol was detained at the prison at the same time as Banyin before the alleged prison escape plan came to light.

              Police suspect Mr Woraphat and Natthapol were involved in the escape plan because the two communicated before the plan was revealed.

              Mr Woraphat on Thursday told police he had no involvement.

              He insisted he was not a friend of Natthapol. Mr Woraphat said they met in prison during a visit and asked Mr Natthapol about his father who was detained in the same section.

              Mr Woraphat, however, admitted to having communicated with Natthapol over the phone about general topics.

              According to Pol Col Anake Taosuphap, deputy chief of the CSD, police agents learned Natthapol contacted Mr Woraphat after the former was released on bail. However, Pol Col Anake said he does not know the details of what was said.

              According to the CSD, the escape plan was uncovered after a team of law enforcement agents arrested a 42-year-old man identified as Suthon “Joe” Thongsiri in Bangkok’s Kapi district shortly after he was released on bail from the prison, the same facility that Banyin was held in before he was transferred.

              Suthon was nabbed on a separate arrest warrant.

              Suthon told police he met Banyin in prison after he was approached to help plan the escape. If the jailbreak attempt failed, Suthon was told to kidnap the wife of BRK’s commander and use her as leverage to secure Banyin’s release.

              Police earlier questioned prison officials and three inmates, who indicated Banyin had arranged the plan, Pol Col Anake said.

                  Thailand’s former Deputy Commerce Minister Banyin Tangpakorn has reversed his not guilty plea and confessed to the kidnapping and murder of the brother of a judge who presided over a fraud trial in which he and three other people were accused of falsifying documents to transfer to their ownership shares, worth about 228 million baht, which belonged to a wealthy contractor.

                  The contractor, Mr. Chuwong sae Tang, died in a suspicious car accident while travelling with Mr. Banyin in the same vehicle.

                  Banyin and five other people are on trial, at the Criminal Court for Corruption and Misconduct Cases, on nine charges related to the abduction and murder of Mr. Veerachai Sakuntaprasert. It is alleged that they attempted to use Veerachai as a hostage to bargain for a lenient sentence in the share transfer case. Ms. Panida did not bow to Banyin’s demand and Veerachai was later killed and his remains destroyed to cover up the crime. Banyin was found guilty and sentenced to eight years in prison.

                  In his written confession, Banyin said that, on February 4th this year, he and his gang kidnapped Mr. Veerachai from in front of Bangkok South Criminal Court, with him dressed in a police uniform and driving a Toyota Sportrider.

                  They planned to hide the hostage at one of Banyin’s house, in Takhli district of Nakhon Sawan province, while negotiating with Ms. Panida. During the journey to the hideout, however, the hostage tried to escape from the car and was killed by Banyin’s men.

                    Banyin sentenced to death, reduced to life

                    A court has sentenced former deputy commerce minister Banyin Tangpakorn to death, with the penalty reduced to life in prison for useful testimony.

                    Five other defendants, who were also convicted of collaborating in the murder of a judge’s brother five years ago, got commuted life or death sentences.

                    The Central Criminal Court for Corruption and Misconduct Cases on Tuesday took two hours to read the sentences for the six defendants.

                    Lt Col Banyin, 56, the first and third defendant in this case, was found guilty of five charges.

                    For detaining a person causing his death, Pol Lt Col Banyin was sentenced to death. The other charges he was found guilty of were collaborating in a premeditated murder (death), impersonating an official (1 year in prison), wearing an official’s uniform (1 year) and hiding or destroying a body (4 years).

                    Since the court found his testimony useful, it commuted his sentence by one third to life in prison.

                    The jail term was added to the eight-year sentence he is currently serving in a share-transfer case linked to this case.

                    The second defendant, who drove the car used in the murder, was convicted of collaborating in a premeditated murder. He got a life sentence, commuted to 33 years and four months in prison.

                    The fourth to sixth defendants were guilty of collaborating in detaining a person causing his death and demanding a ransom. They were sentenced to death, commuted to life imprisonment.

                    The court found the six guilty of all charges except being members of a secret society or criminal association since the crime did not meet some elements of the offence, such as sitting down together to plot a crime.

                    Background

                    In June 2015, Pol Lt Col Banyin drove a car and hit a roadside tree in Suan Luang district, Bangkok. Chuwong Saetang, a billionaire contractor who sat in the front seat with him, was killed.

                    Police later suspected the crash might not have been an accident. They found the vehicle was travelling at 30km/h when the crash occurred. An autopsy showed Chuwong sustained injuries unrelated to the crash such as broken ribs and stretched marks on his neck.

                    The distance between the golf course where they practised golf and Chuwong’s house was 20km. However, the period from their departure from the golf course to when the crash took place was two hours. Chuwong’s family suspected he might have been killed somewhere else before the collision.

                    A look into Chuwong's financial affairs raised more suspicions. Ten days before the crash, he transferred shares worth 38 million baht to a marketing officer at a stock brokerage closed to Pol Lt Col Banyin. Another 228 million baht worth of shares was transferred to a caddie at a golf course. Evidence suggested at the time the shares might have been transferred using forged documents orchestrated by Pol Col Banyin.

                    Public prosecutors and Chuwong’s family later charged Pol Col Banyin in two cases — forging documents and murder.

                    Since both cases were closely linked, if Pol Lt Col Banyin was found guilty in the share transfer case, he could meet the same fate in the murder case.

                    The South Bangkok Criminal Court, under judge Panida Sakuntaprasert, handled the share transfer case.

                    Ms Panida said she had been threatened several times to dismiss the case. Fearing for her safety, she asked her brother Veerachai to pick her up every day after work.

                    In early February this year, 3-4 men kidnapped Veerachai from in front of the court and pressured Ms Panida to dismiss the case. Veerachai’s bruised body was later found in a river in Nakhon Sawan.

                    A suspect was later caught, who claimed Pol Lt Col Banyin was behind the plot. Pol Lt Col Banyin was arrested later that month.

                    In the following month, the Criminal Court sentenced Pol Lt Col Banyin to eight years for document forgery in the share-transfer case.

                    While in prison, Pol Lt Col Banyin tried unsuccessfully to escape by soliciting help from some fellow inmates. He also reportedly attempted to kill himself in a cell in June.

                    Pol Lt Banyin was a former two-time Pheu Thai MP for Nakhon Sawan and a list MP for Matchima Party earlier. In 2000, he served as a deputy commerce minister in the Samak Sundaravej and Somchai Wongsawat governments.

                      Banyin gets death sentence for murder of Chuwong

                      Former commerce minister Banyin Tangpakorn has been sentenced to death for the premeditated murder of construction tycoon Chuwong Sae Tang that he tried to pass off as a car accident six years ago.

                      The Phra Khanong Criminal Court on Wednesday handed down the maximum penalty for the 56-year-old former Nakhon Sawan MP.

                      The court said the death sentence was warranted as Banyin, a former senior police officer, had never confessed to the murder, although all evidence showed the victim was slain.

                      On June 26, 2015 Chuwong, 50, was found dead in the passenger seat of a black Lexus SUV driven by Banyin after the vehicle hit a roadside tree in Suan Luang district of Bangkok.

                      Banyin was only slightly injured. He told police that his close friend died because he did not buckle up his safety belt.

                      The court said the evidence showed the accident was staged, an attempt to cover-up a murder.

                      The ruling was delivered to the defendant via video conference. He is serving a life sentence in high-security Bang Kwang Central Prison for conspiring in the murder five years ago of Wirachai Sakuntaprasoet, the brother of a judge handling his case.

                      He is also serving time over the fraudulent transfer of shares after the death of Chuwong, a construction billionaire.

                      Banyin continued to clam in court that Chuwong died in a car accident after the two men had been playing golf together. Investigators were not convinced as the car was travelling only about 30kph, damage was minor and an autopsy revealed causes of death unrelated to the crash.

                      Police tracked Chuwong’s financial affairs and found he had apparently transferred shares worth 38 million baht to an employee at a stock broking firm who was close to Banyin.

                      Another 228 million baht worth of shares was transferred to a caddie at a golf course.
