            The National Anti-Corruption Commission will send the rice-pledging scheme impeachment case against Yingluck Shinawatra to the National Legislative Assembly. At a meeting on Thursday, the NACC also reaffirmed the law that authorises the NLA to impeach the former prime minister.

                  NACC secretary general Sansern Poljiak said that the NACC board also resolved that the NLA could proceed to remove Ms Yingluck and other politicians facing impeachment charges from office under the 1999 anti-corruption organic law even though the 2007 constitution was scrapped after the May 22 coup.

                  • Attorney: NACC's Corruption Case Against Yingluck Still Incomplete

                    BANGKOK - The Office of Attorney-General has yet to take up the corruption charge against former Prime Minister Yingluck Shinawatra, due to the lack of sufficient evidence submitted by the National Anti-Corruption Commission (NACC).

                    "The case filed by the NACC is still incomplete," said Chutichai Sakakorn, a leading member of the Office of Attorney-General (AG), "The AG will continue to consider the matter and re-convene another meeting to decide whether we will prosecute the case in the Supreme Court's Division for Persons Holding Political Office."

                    NACC representatives were meeting with the AG today to discuss the unfinished case file.

                    In July the NACC found Yingluck guilty of negligence that led to a massive corruption in the rice-pledging scheme, a key policy undertaken by her administration. According to the NACC, Yingluck's failure to tackle the corruption ended up costing the Kingdom more than 500 billion baht in damages.

                    Under Thai laws, the NACC could ask the AG to prosecute the former Prime Minister in the Supreme Court's Division for Persons Holding Political Office. Yingluck could face up to 10 years in prison if found guilty by the court.

                    However, the AG has so far refused to take up the case due to a lack of clear evidence that implicates Yingluck in the corruption. Last month, a spokesperson of the AG Office publicly criticised the NACC for citing an academic paper as a proof of Yingluck's involvement in the graft, yet the Commission only attached a photocopy of the paper in its evidence filing.

                    It later emerged that the paper in question was also published before the rice mortgage scheme kicked off.

                    Sansern Poljiak, sec-gen of the NACC, admitted today that the Commission failed to convince the AG to accept the case. "Each side has to go back to work on the case, and come back for another meeting," Sansern said.

                    Sansern suggested that if the AG ultimately decided not to take up the case against Yingluck, the NACC may be able to act as the prosecutor in the trial instead.

                    Although the NACC insisted that its anti-graft crusade against Yingluck is impartial and in accordance with rule of laws, supporters of the former Prime Minister views it as an attempt by the NACC and other so-called "independent agencies" to dismantle the political base of Yingluck and her allies.

                    Critics of the NACC compares its perceived overzealous effort to pursue corruption charges against Yingluck with its nonchalant attitude toward the military junta and its rubber stamp legislative bodies.

                    The NACC previously ruled that members of the Cabinet and the National Reform Council (NRC) are not obliged to declare their assets, as opposed to the usual requirement for holders of political office in Thailand.

                        Rice husk surface among huge stockpiles of cassava

                        Commerce officials have uncovered rice husk among huge stockpiles of cassava kept at privately-owned warehouses indicating another corruption scandal in the pledging scheme of the previous government.

                        The finding was a joint inspection of officials from the Commerce Ministry and the Public Warehouse Organisation (PWO) to examine the conditions of the remaining 497,000 tons of casava stocks kept at privately-owned warehouses across the country.

                        The ministry wanted to know exactly how much are good and bad are remained in the stocks before calling for auction to save warehouse cost.

                        The inspection of warehouses in Ratchaburi and Ayutthaya provinces revealed rice husk among the cassava stockpiles indicating fishy practice either by the private warehouse owners or state officials or it was a collaboration.

                        Inspection officials discovered piles of big bags containing rice husk were placed on top of rows of cassava sacks and then covered by cassava sacks on the top row.

                        Officials have filed complaints with the police and planned to file criminal charges against all relevant people, and to demand compensation for the loss.

                        It was not immediately known how much was stolen but initial assessment revealed several tens of thousands of tons were missing from the stockpiles.

                        Officials said keeping cassava and rice in warehouse was different as rice needed more than one person to hold the key and open the warehouse.

                        Opening rice warehouse is more stringent, officials said.

                        One official said that for cassava stockpiles, warehouse owner can open the warehouse to check or it required rotation of rows of cassava sacks once in a two-month period for ventilation and prevent moisture.

                        This practice could allow a chance for unscrupulous warehouse owner to steal them for sales when it fetches good price, and buy back to fill the missing when price falls.

                        The PWO board d has ordered its management to check all stockpiles to see how much us missing and how much is remaining good before pursuing court cases against all involved.

                            A former lawyer for deposed prime minister Yingluck Shinawatra has called for more oversight of the National Anti-Corruption Commission in the wake of the agency's handling of the rice-pledging case against the ex-premier.

                            Bancha Poramisanaporn, a National Reform Council member who served on the defence team for Ms Yingluck in the case, said politicians should be granted the power to order the investigation of NACC members.

                            The proposal drew swift condemnation from the Democrat Party legal team, who said it would lead to intimidation of members of the anti-graft body.

                            Reporting for duty at the NRC yesterday, Mr Bancha said he would recommend a joint committee be set up comprising members of the both houses of parliament to conduct inquiries into allegations of unfair treatment submitted by those who are investigated by the anti-graft agency.

                            If the committee finds grounds to the allegations, parliament would then vote on whether the case should go before the Supreme Court's Criminal Division for Holders of Political Positions.

                            Under Mr Bancha's plan, support from just one-tenth of the members of parliament would be enough to send the case to court.

                            At present, there is no direct oversight of the NACC, although individuals are able to launch standard defamation proceedings if the feel they have been improperly treated.

                            NACC chairman Parnthep Klanarongran has recently suggested members of the agency should be tried by the Supreme Court's Criminal Division for Holders of Political Positions if there are complaints against them, though he did not elaborate further on the grounds for complaint.

                            The NACC in May found Ms Yingluck guilty of negligence for ignoring evidence of corruption in the rice subsidy programme. On Thursday, it lodged a petition with the National Legislative Assembly calling for the former premier's impeachment for her role in the scheme.

                            Mr Bancha has clashed openly with NACC members over the agency's handling of the charges against Ms Yingluck, particularly over its refusal to allow testimony from several key defence witnesses.

                            But he stressed yesterday that he was not accusing the NACC of mistreating Ms Yingluck, noting that he has not worked on the rice-pledging scheme case since April.

                            He said the proposal is intended to ensure transparency in NACC investigations, noting that eradicating graft and corruption are core policies of the National Council for Peace and Order and the government.

                            Democrat Party legal team member Wirat Kallayasiri said there are already enough safeguards in place to prevent NACC wrongdoing, saying subjects can lodge complaints with police.

                            Mr Wirat said Mr Bancha's proposal giving the House authority to investigate members of the NACC and impeach them seemed impossible, since the NACC's primary duty is to investigate politicians and government officials.

                            If the House is given a mandate to investigate and impeach NACC members, he said, it could be used as a form of intimidation and prevent the agency from doing its job.

                            "Mr Bancha can think about this plan, but he is going to find it difficult to change. The NRC will not accept his proposal," he said.

                            Mr Bancha represents independent lawyers at the reform council and said he intends to push for better checks and balances against independent organisations.

                            He also welcomed yesterday a proposal to drop the 20-year statute of limitations on all corruption cases. This would especially apply in cases where NACC members are accused of unfair treatment.

                            He said the NACC should not be dissolved, but the agency should be made accountable and its work fair and transparent.

                            "The NACC should not be dissolved, but reformed. And its members shouldn't be worried. This [proposal] will prove the NACC doesn't abuse anyone," he said.

                            Discussing other potential judicial reforms, Mr Bancha said the questioning of witnesses and suspects by police should be recorded and presented in court.

                              National Anti-Corruption Commission president Panthep Klanarongran has defended the NACC's conduct in the proposed impeachment case involving former prime minister Yingluck Shinawatra.

                              In response to the former premier's lawyers claiming the NACC had rushed to submit the case, Panthep said the commission had handled the case in accordance with standard procedures and had drawn conclusions a long time ago.

                              However, he said the case could not be submitted to the Senate because the junta dissolved the upper House.

                              The anti-graft body was also questioned by Yingluck's lawyers as to why it had submitted the case to the National Legislative Assembly when the Office of the Attorney-General had said its report was incomplete.

                              Panthep said the case submitted to the NLA was an impeachment matter - distinct and unrelated to the criminal case submitted to the Office.

                              He was asked why the case submitted to the NLA did not refer to the alleged violation of Article 178 of the 2007 Constitution, which contradicted its earlier consensus, but only referred to the alleged violation of Article 11 of the charter.

                              He said the alleged violation of both Article 178 and Article 11 had been clearly stated in the case, which would be submitted to the NLA this week.
